Apex Health & Wellness, PLLC ("Apex Health & Wellness," "we," "us," or "our") respects the privacy of every individual who visits our website. This Privacy Policy describes how we collect, use, disclose, and protect information gathered through apex-healthwellness.com (the "Site") and through related communications such as email and appointment reminders.
This Privacy Policy applies to information collected through the Site and our marketing and scheduling communications. Patient health information created or received in the course of a treatment relationship is governed by our Notice of Privacy Practices, which is provided to every patient at intake and is available upon request. Where this Privacy Policy and the Notice of Privacy Practices both apply, the Notice of Privacy Practices controls with respect to patient health information.
Washington residents should also review our Consumer Health Data Privacy Policy, linked in the footer of every page of the Site, which describes how we handle consumer health data under the Washington My Health My Data Act.
1. Compliance With Applicable Privacy Laws and Protected Health Information
Apex Health & Wellness operates in compliance with the privacy laws and regulations applicable to the jurisdiction we serve, Washington State, and with federal law governing protected health information.
HIPAA. Patient health information created or received in the course of treatment at Apex Health & Wellness is handled in accordance with the standards established by the Health Insurance Portability and Accountability Act and its implementing regulations, including the Privacy Rule and Security Rule. Such information is used and disclosed only as described in our Notice of Privacy Practices, which is provided to every patient at intake and is available upon request. We maintain administrative, technical, and physical safeguards for patient health information, including a HIPAA-compliant telehealth platform, a secure electronic health record system, encrypted transmission of patient data, and access controls limiting access to personnel who require it to perform their duties. Vendors that handle patient health information on our behalf are bound by written agreements consistent with HIPAA's business associate requirements.
Washington My Health My Data Act (Chapter 19.373 RCW). Health-related information collected through the Site outside of an established treatment relationship is consumer health data under Washington law. We collect such data only with consent, we do not sell it, and we handle it in accordance with our Consumer Health Data Privacy Policy, which is posted as a separate, prominently linked page on the Site and describes the categories of data collected, the purposes of collection, the entities with which data is shared, and the rights of Washington residents to access, delete, and withdraw consent regarding their consumer health data.
Washington Uniform Health Care Information Act (Chapter 70.02 RCW). Health care records are maintained, disclosed, and retained in accordance with Washington State law governing health care information, including state requirements for patient access to records and medical records retention.
We review our privacy and security practices on an ongoing basis to maintain compliance with these laws as they are amended and as regulatory guidance evolves.
2. Information We Collect
Information you provide directly. We collect information you choose to submit through the Site, including your name, email address, phone number, and mailing address when you complete a contact form, request information, subscribe to our email list, or book an appointment. When you book a visit, we also collect the information requested in our booking and intake forms, which may include your reason for visit, health goals, symptoms, allergies, current medications and supplements, and emergency contact information, so that we can prepare appropriately for your care. Health-related information submitted through the Site is treated as consumer health data and is addressed in our Consumer Health Data Privacy Policy.
Information collected automatically. When you visit the Site, we collect certain information automatically through the built-in analytics tools provided by our website platform, Squarespace. This includes your IP address, browser type, device type, operating system, referring pages, pages viewed, and the dates and times of your visits. This information is collected through cookies and similar technologies and is used in aggregate to understand how visitors use the Site. We do not currently use third-party advertising pixels or cross-site tracking tools on the Site.
Payment information. If you purchase services or products, payment is processed by third-party payment processors. We do not store complete payment card numbers on our own systems. Payment processors handle your card information under their own privacy policies and security standards.
3. How We Use Your Information
We use the information we collect to respond to your inquiries, schedule and confirm appointments, provide the care, services, and products you book or purchase, send appointment reminders, process payments, maintain the security and functionality of the Site, comply with legal and regulatory obligations, and improve our Site and services. We may also use the email address you provide when subscribing to our list or booking an appointment or discovery call to send educational content, practice updates, and information about Apex Health & Wellness services. You may unsubscribe from these communications at any time using the link included in every email.
We do not sell your personal information, and we do not share your personal information with third parties for their own advertising or marketing purposes.
4. Text Messages
We send text messages for appointment reminders and appointment-related communications only. We do not send marketing text messages. By providing your mobile number when booking an appointment, you consent to receive appointment-related text messages. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Mobile phone numbers and text messaging consent are not shared with third parties or affiliates for marketing purposes.
5. How We Share Information
We share information only as necessary to operate our practice and the Site, including with the following categories of service providers, each of which is permitted to use your information only to provide services to us:
Our website hosting platform (Squarespace), our scheduling and electronic health record systems, our email marketing platform used to deliver communications described in this policy, our payment processors, licensed pharmacies used to fill prescriptions issued in the course of your care, and, when you choose to use them, our supplement dispensary and laboratory ordering platforms.
We may also disclose information when required by law, regulation, subpoena, or court order, when necessary to protect the rights, safety, or property of Apex Health & Wellness, our patients, or others, or in connection with a corporate transaction such as a sale, merger, or reorganization of the practice, subject to applicable law.
6. Cookies
The Site uses cookies placed by Squarespace to enable core site functionality and to collect the aggregate analytics described above. You can manage or disable cookies through your browser settings, though some Site features may not function properly without them.
7. Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect, including secure hosting, encrypted transmission, and access controls limiting information to personnel who need it to perform their duties. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Data Retention
We retain information for as long as needed to fulfill the purposes described in this Privacy Policy, to comply with legal, regulatory, and professional recordkeeping obligations, and to resolve disputes. Information that becomes part of a patient record is retained in accordance with Washington medical records retention requirements.
9. Your Choices and Rights
You may unsubscribe from marketing emails at any time using the link included in every email. You may opt out of appointment reminder texts by replying STOP. You may request access to, correction of, or deletion of personal information we hold about you by contacting us using the information below. Certain information may be exempt from deletion where retention is required by law, including health records we are obligated to maintain. Washington residents have additional rights with respect to consumer health data, described in our Consumer Health Data Privacy Policy.
10. Children's Privacy
The Site is not directed to children, and we do not knowingly collect personal information from anyone under the age of 18 through the Site. If you believe a minor has provided personal information through the Site, please contact us so we can delete it.
11. Third-Party Links
The Site contains links to third-party websites and platforms, including scheduling, supplement dispensary, and laboratory ordering services. Those sites operate under their own privacy policies, and we encourage you to review them. This Privacy Policy applies only to information collected by Apex Health & Wellness.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The effective date at the top of this page reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Site after changes are posted constitutes acceptance of the revised policy.
