This Consumer Health Data Privacy Policy is provided in accordance with the Washington My Health My Data Act (RCW 19.373) and describes how Apex Health & Wellness, PLLC ("we," "us," or "our") collects, uses, and shares consumer health data through apex-healthwellness.com (the "Site") and related communications.
Scope. This policy applies to consumer health data as defined by the My Health My Data Act. It does not apply to protected health information governed by HIPAA, which includes information created or received as part of an established treatment relationship with our practice. That information is governed by our Notice of Privacy Practices, provided to patients separately. In general, this policy covers health-related information you submit through the Site before or outside of a treatment relationship, such as information provided through website forms and inquiries.
1. Categories of Consumer Health Data We Collect
Depending on what you choose to share with us through the Site, we may collect the following categories of consumer health data: health conditions, symptoms, allergies, or diagnoses you describe in a form or inquiry; your stated reason for seeking a visit; health and wellness goals; medications, supplements, or therapies you report using or ask about; interest in specific clinical services such as hormone optimization, IV nutrient therapy, functional medicine evaluation, or regenerative procedures/protcols; and appointment booking information that reveals your interest in seeking health services.
We collect this data directly from you when you submit it through contact forms, intake-style questions, email inquiries, or appointment booking. We do not collect consumer health data from third-party sources, we do not use advertising pixels or cross-site trackers on the Site, and we do not infer consumer health data from your browsing activity.
2. Purposes for Collection and Use
We collect and use consumer health data solely to respond to your inquiry, determine whether our services are appropriate for your needs, schedule and prepare for your appointment, and communicate with you about the services you have requested. With your consent, we may also use the contact information you provide when booking to send you educational content and information about Apex Health & Wellness services; you may opt out of these communications at any time. We collect consumer health data with your consent, which you provide when you voluntarily submit it through the Site, and we use it only for the purposes disclosed in this policy.
3. Sharing of Consumer Health Data
We do not sell consumer health data, and we will not sell consumer health data without the separate, signed authorization required by Washington law. We do not share consumer health data with affiliates or with third parties for their own purposes.
Consumer health data is shared only with service providers that process it on our behalf and under our instructions, specifically our website hosting platform, our scheduling and electronic health record systems, and our practice communication tools. Each processor is bound by contractual obligations limiting its use of the data to providing services to us. We may also disclose consumer health data when required by law or legal process, or to prevent imminent harm.
4. Your Rights Under the My Health My Data Act
If you are a Washington resident, you have the right to confirm whether we are collecting, sharing, or selling your consumer health data and to access that data, including a list of third parties and affiliates with whom we have shared it; the right to withdraw consent to our collection and sharing of your consumer health data; and the right to have your consumer health data deleted.
How to exercise your rights. Submit a request by emailing contact@apex-healthwellness.com with the subject line "Consumer Health Data Request," or by writing to the address below. We may need to verify your identity before fulfilling a request. We will respond within the timeframes required by Washington law.
Deletion. Upon a verified deletion request, we will delete your consumer health data from our records and direct our processors to do the same, except where retention is required or permitted by law. Please note that information incorporated into a medical record as part of a treatment relationship is protected health information governed by HIPAA and Washington medical records laws, and is subject to legally mandated retention periods rather than this policy.
Appeals. If we decline to act on your request, you may appeal by replying to our response or emailing contact@apex-healthwellness.com with the subject line "Consumer Health Data Appeal." We will respond to your appeal in writing within the timeframe required by law, including the reasons for our decision. If your appeal is denied, you may contact the Washington State Attorney General at www.atg.wa.gov to submit a complaint.
